This privacy policy describes how Rakuten Europe S.à r.l (“Rakuten”, “we”, “our”, “us”) collects and processes personal data about you (“you” or “your”), how we use and protect those data, and your rights in relation to them, when you use the website www.rakuten.co.uk (or its successor) and any related services (the « Service(s) »). 

The Service is a rewarding loyalty programme that allows you to receive rewards for purchases concluded between you and the affiliated stores listed on the Service (“Affiliate Stores”). We call this reward “cashback”. The amount of remuneration (as a rule, but not always) depends on the amount of the purchase, and this percentage may vary. Rakuten also offers you the option to withdraw your accumulated cashback rewards to your bank account or any other type of account we offer or to convert it into Rakuten Points.

This privacy notice applies to all personal data we collect or process about you. Personal data is any information about you, as well as a combination of pieces of information that could reasonably allow you or your household to be identified.

Who controls my data?

Any data that you provide to us through your use of the Service is controlled by Rakuten Europe S.à r.l., 2 rue du Fossé, L-1536 Luxembourg, registered under number B136664 at the Luxembourg Trade and Companies Register, with the VAT number LU22375408.

Rakuten Europe is part of the Rakuten Group, which includes the affiliates and subsidiaries of our parent company Rakuten Group, Inc., based in Tokyo, Japan. More information about Rakuten is available at https://global.rakuten.com/corp/about/company (“Rakuten Group”).

The data we collect

We collect and store certain data as a result of your interactions with our Service:

  • Your name;
  • Your login ID and password;
  • Your email address;
  • The amount of accumulated cashback rewards, that you can choose to convert into cash or Rakuten Points;
  • The number of Rakuten Points that you receive and that you can use on Rakuten services (Kobo, Viber and/or Rakuten TV) or that you can convert into gift cards and Socios vouchers, if offered in your market;
  • Any offer from the Affiliate Stores you viewed or searched for;
  • Information about your interaction, communication and connectivity data;
  • The Internet protocol (IP) address used to connect your computer or mobile device to the Internet;
  • Your computer or mobile device and connection information such as your browser type and version, your operating system and platform;
  • The full Uniform Resource Locators (URL) clickstream to, through and from the relevant Service (including date and time);
  • The UTM parameters of the campaign;
  • Internet or other electronic network activity information, such as information about your online browsing behaviour, preferences, and shopping history. Some of this information we collect automatically from you, e.g. data collected using cookies and other device identifying technologies ('Cookies and Tracking Technologies');  
  • For cashback reward redemption: obfuscated IBAN to which the cashback is transferred and our partner payment provider token corresponding to your account;
  • A record of cashback rewards withdrawal transactions you made, including the amount that was transferred, the time at which the transfer happened and a transfer identifier;
  • Your user’s segmentation in order to personalize your experience (in newsletters & offers on the website);
  • If you use our toolbar functionality, your member UUID (in a cookie);
  • If you choose to participate in our Referral Programs as referrer (because you invite your friends), we collect the invitation code we generate for you, when it is generated, and for which campaign.
  • If you choose to participate in our Referral programs as a referee (because a friend has invited you to join Rakuten), we will link the invitation code you used, when you used it, and for which campaign, to your account, only after you create an account with us.

We collect the following information from other sources:

When you register or sign up for our Services using third parties’ services, we collect personal data about you from third parties, at your request, to allow your registration and authentication in our Services. The categories of information that we collect about you from these sources are: 

·       Apple: email address, given name, last name

·       Google: email address, given name, last name, language preference, profile picture

·       Facebook: email address, given name, last name, profile picture

When you register or sign up for our Service using third parties’ services, this data will be shared with Rakuten ID Services for account creation. You can read further details in the section “Whom we share your data with”. The subsequent use of your data by these third parties is governed by their own Terms & Conditions and Privacy Policy.

We may combine your data with data lawfully obtained from other third party sources and use it for the above purposes. This is the case when we receive the information about what you bought from our Affiliate Stores, in order to allocate your cashback.

It is your responsibility to update and maintain accurate contact information in your Rakuten account. You can make changes by visiting your account page and entering corrections.

Please note that we may be required by law to collect certain personal data about you, or as a consequence of any contractual relationship we have with you. Failure to provide this information may prevent or delay the fulfilment of these obligations. We will inform you at the time your data is collected whether certain data is compulsory and the consequences of the failure to provide such data.

How we use your data

We collect and store this data as a result of your interactions with our Services, for the following purposes:

·       Identification and authentication: We use your identifiers to verify your identity when you access your Rakuten ID account and to ensure the security of your personal data. The Rakuten ID also enables you to use other services provided by other Rakuten Group companies (as explained below);

·       Providing the Service: We process your personal data to provide you with access to the Service, notably to grant you and allow you to withdraw your cashback.

·       Improving the Service: We analyse information about how you use the Service to provide an improved experience for all users and improve the Rakuten services and for business development;

·       Customising your experience and recommendations: When you use the Service, we may use your personal data to improve your experience, such as by providing interactive or personalised elements and providing you with recommendations based on your interests; 

·       Communicating with you: We may use your personal data to communicate with you, for example if we are providing information about changes to the terms and conditions, if you contact us with questions , or if we provide you with a summary of your available cashback and points by email;

·       Administer Referral programs, if you choose to participate in them.

·       Marketing: We may use your personal data to build a profile about you and place you into particular marketing segments in order to understand your preferences better and to appropriately personalise the marketing messages we send to you. We may also use your identifiers to send you marketing communications about the Service and other products or services that may be of interest to you; 

·       Exercising our rights: We may use your personal data to exercise our legal rights where it is necessary to do so, for example to detect, prevent and respond to fraud claims, intellectual property infringement claims or violations of law or our terms and conditions;

·       Complying with our obligations: We may process your personal data to comply with legal or regulatory requirements, where this is explicitly required by law, such as in response to court orders or to comply with privacy or financial regulations;

·       Protecting against harm: We may use personal data as necessary to protect the rights and safety of us, you, or others, notably to identify and fight against fraudulent behaviours. In some identified fraudulent cases, we reserve the right not to allocate you cashback rewards.

We must have a legal basis to process your personal data. In most cases the legal basis will be one of the following: 

  1. To fulfil our contractual obligations to you, for example to provide the services, to ensure that cashback is granted correctly. Failure to provide this information may prevent or delay the fulfilment of these contractual obligations;
  2. To comply with our legal obligations;
  3. To meet our legitimate interests, for example to understand how you use our products and services and to enable us to derive knowledge from that, which allows us to develop new products and services. When we process personal data to meet our legitimate interests, we put in place robust safeguards to ensure that your privacy is protected and to ensure that our legitimate interests are not overridden by your interests or fundamental rights and freedoms.
  4. We may obtain your consent to collect and use certain types of personal data when we are required to do so by law (for example, in relation to our direct marketing activities). If we ask for your consent to process your personal data, you may withdraw your consent at any time by contacting us using the details at the end of this privacy notice.

Who we share your data with

We may share this data with the following third parties, including other Rakuten Group companies and technical and other service providers:

Service providers and business partners. We may share your personal data with our service providers and business partners that perform marketing services and other business operations for us. For example, we may partner with other companies to process secure cashback withdrawals, fulfil orders, send newsletters, support email and messaging services. We ensure that all business/technical partners and relevant third parties are bound by contractually binding promises to process data we share with them in accordance with our directions, this Privacy Policy, and applicable data protection laws.

Advertisement partners and affiliate networks. If you engage in a transaction on an Affiliate Store, some of your data may be shared with this Affiliate Store for the purpose of rewarding you with cashback rewards.

Law enforcement agencies, courts, regulators and government authorities. If lawfully requested, we may also share data with law enforcement agencies and/or third parties in respect of data requests for criminal investigations and alleged illegal activities.

Asset purchasers. Your data may also be transferred to another company in the event of sale of the whole or part of our business to a third party.

The Rakuten Group (Rakuten ID and Rakuten Points). The Rakuten Group aims to provide you with a unique service experience through the “Rakuten ID”. Rakuten ID is a unified programme that allows you to easily connect to other Rakuten services by a single log-in function, share your account information and join a loyalty programme with the Rakuten Group companies jointly participating in the Rakuten ID programme. Your data will only be shared if you chose to connect to another Rakuten ID Service. By connecting to another Rakuten ID Service, you direct the Rakuten ID services to share your data for the purposes explained in our joint privacy policy here: https://corp.rakuten.co.jp/privacy/en/rakuten-id.html.

We share your account credentials and profile information with the Rakuten ID services. This service is jointly provided by the Rakuten ID Services as directed by you, if you sign up with another Rakuten ID Service.

Some of these Rakuten Services, with which your data may be shared, are located in countries in which the level of data protection is not equivalent to the European one. However, the Rakuten Group has adopted Binding Corporate Rules which guarantee a proper level of data protection amongst all the Rakuten Services. You can consult this document here.

In any case, we remind you that, if you choose to use another Rakuten Service, your data will be processed in line with its own privacy policy.

Additional data sharing with Rakuten Group. We may share your data (transactional and navigational data, and, with your consent, geolocation data, possibly collected via cookies or similar technologies) with the other companies of the Rakuten Group, for the following purposes:

A. To make statistical analysis (for example, to know how many users are using more than one Rakuten services) and improve the Rakuten services and business development;

B. To personalise the products, services and offers, such as vouchers and campaigns that are presented to you on the Rakuten Group companies’ services based on the interactions you had with the other Rakuten services;

C. To detect, prevent and respond to fraud claims, illegal activity, intellectual property infringement claims or violations of law or our terms and conditions;

D. To provide you marketing communications and notifications (by mail, text message, flyer and/or phone call) about the Rakuten Group companies’ offers;

E. To personalise the advertisements that are being shown to you on the Rakuten Group companies’ services and outside based on the interactions you had on the Rakuten services and outside;

F. For credit scoring according to your (payment) behaviour on the Rakuten services and insurance risk scoring in line with the applicable laws; 

G. To comply with legal or regulatory requirements, where this is explicitly required by law, such as in response to court orders, police requests; and 

H. To answer your requests, claims, complaints and users' rights. 

In the European Union, we need to have a legal basis for processing your personal data. For purposes A to D, Rakuten relies on its legitimate interest to offer you the best experience on Rakuten services. For purposes D to F, Rakuten relies on your consent. For purpose G, we rely on compliance with legal obligations (e.g. lawful law enforcement requests) and for purpose H, we rely on the performance of our (pre-)contractual obligations with you. You have certain rights regarding your personal data, subject to local law. Please refer to this section.

Transfers of your data

Your personal data may be transferred to countries which may not have equivalent protections for your data as your country of residence, notably to the countries in which Rakuten Group companies are based. We ensure that your rights and freedoms in respect of the processing of your personal data are adequately and appropriately protected and to comply with all legal requirements.

As part of the Rakuten Group, we rely on the Rakuten Group Binding Corporate Rules to legitimise international data transfers within the Group. The Rakuten Group Binding Corporate Rules can be found at https://corp.rakuten.co.jp/privacy/en/bcr.html. For transfers outside of the Rakuten Group, we rely on Standard Contractual Clauses.

Your rights related to your personal data

You have certain rights regarding your personal data. These include the following rights to:

·       access your personal data

·       rectify the information we hold about you

·       erase your personal data

·       restrict our use of your personal data 

·       object to our use of your personal data

·       receive your personal data in a usable electronic format and transmit it to an external party (right to data portability)

·       lodge a complaint with your local data protection authority.

We encourage you to contact us to update or correct your information if it changes or if the personal data we hold about you is inaccurate. To update your profile information by yourself, simply log into your account and update your information directly there.

To exercise your rights, please contact us via the red support icon at the bottom right of the screen on any page ("Delete Account & Privacy Policy" option).

If you want to delete your account automatically, you can also do this directly in your account under "My Account > Services & Privacy > Delete my account for this service".

Marketing preferences

We send two types of emails to you: customer service emails required to maintain the Services and promotional emails containing special offers, discounts and promotions offered by Rakuten Europe and other Rakuten Group companies, if you have chosen to receive such promotional communications.

While customer service emails are necessary to make you benefit from our Services, you may choose not to receive promotional emails at any time by clicking the « unsubscribe » link in any promotional email or by modifying your subscription preferences in your account.

You may also receive promotional emails containing information and special offers from third parties if you have consented to receiving such communications (only in case we offer that possibility on the Services).

Members can also redeem points for donations to charitable causes.  ii. Perks. As well as Points, Rakuten recognises members with exclusive and aspirational Perks – Money can’t buy benefits, special treats, and prize draws. iii. Prize draws. We organize prize draws, contests, surveys or promotions from time to time. If you choose to participate in a prize draw, contest or promotion, your personal data may be used to administer it.
  • Improving the Services: We analyse information about how you use the Services to provide an improved experience for all users and improve the Rakuten services and for business development;

When redeeming your Rakuten Points, we will also share some of your data with the Rakuten services on which you choose to redeem them. Please note that all Rakuten Services do not necessarily allow you to use Rakuten ID and/or to earn and redeem Rakuten Points on them.

Some of these Rakuten Services, with which your data may be shared, are located in countries in which the level of data protection is not equivalent to the European one. Security and data retention

We implement technical and organisational measures to ensure a level of security appropriate to the risk to the personal information we process. Refer a friend program

"The Information We Collect. If you participate in the Refer a Friend Program, we will collect information related to your participation in the program and the use of invitation codes, rewards, coupons, rebates and incentives provided to you. The Referrer's information will be linked to the Referrer and used for the creation of the Rakuten ID account. Both Referrer and Referral purchase information will be collected to allocate rewards as outlined in the Refer a Friend Program Terms and Conditions."
